Common questions
What is 44ADA?
Presumptive taxation for professionals such as software developers, designers, consultants, doctors, lawyers and architects. You declare 50% of your receipts as profit and pay tax on that, with no need to keep detailed books or prove expenses. You can declare more than 50%, but declaring less needs books and usually an audit. The Income-tax Act, 2025 carries the same scheme into tax year 2026-27 under a new section number.
Who can use it?
Resident professionals with receipts up to ₹50 lakh a year, or up to ₹75 lakh if no more than 5% of receipts came in cash. Above that, tax is worked out on actual profit.
Do I pay no tax if I earn ₹20 lakh as a freelancer?
Often, yes. Under 44ADA, ₹20 lakh of fees is ₹10 lakh of profit, and in the new regime income up to ₹12 lakh gets a full rebate. Any TDS your clients deducted then comes back as a refund when you file your return.
How much TDS do clients deduct?
Usually 10% of professional fees under section 194J once a client pays you more than ₹50,000 in a year (2% for some technical services). It is tax already paid on your behalf; it shows in Form 26AS and AIS and is subtracted from your final tax.
When do I pay advance tax?
If your tax after TDS is ₹10,000 or more: under 44ADA, all of it by 15 March. Otherwise in four parts by 15 June, 15 September, 15 December and 15 March.
